Statutory Rule 2005 No. 437

The Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2005




The Department of the Environment, in exercise of the power conferred upon it by Article 17(7) of the Clean Air (Northern Ireland) Order 1981[1] and of all other powers enabling it in that behalf, being satisfied that the classes of fireplace described in column (1) of the Schedule can be used for burning fuel other than authorised fuels without producing a substantial quantity of smoke, hereby makes the following Regulations:

    (1) These Regulations may be cited as the Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 30th October 2005.
    (2) In these Regulations "the Principal Regulations" means the Smoke Control Areas (Exempted Fireplaces) Regulations Northern Ireland 1999

Conditions

The Orchard Ovens models:
FVR Speciale 80, 100, 110, 110x160 and 120
TOP Superiore 100 and 120
GR 100, 120, 140, 120x160, 140x160, 140x180 and 180
the Valoriani Piccolo

all of which are manufactured by Valoriani of Via Caselli alla Fornace, Reggello, Firenze, Italy.

1: The fireplaces shall be installed, maintained and operated in accordance with the manufacturer's instructions dated 25th October 2004.

2: No fuel shall be used other than untreated dry wood.
