What is a Dutyholder?

The Dutyholder is the person or organisation that has a clear responsibility for the maintenance or repair of non-domestic premises through an explicit agreement such as a tenancy agreement or contract.

The extent of this duty will depend on the nature of the agreement. Usually it is the owner or leaseholder who has the duty. Managing agents are considered as Dutyholders when the responsibility is passed onto them.

Quite simply, it means that owners, employers and managers of non-domestic premises, including managed residential premises, will be required to assess and have in place a managed asbestos survey, whether work on the premises is planned or not. In the HSE's eyes, someone, somewhere has the duty to manage the asbestos in a particular building.
